Liability Waiver

The Participant, by registering and becoming a guest of The Point, LLC (hereinafter “The Point”), warrants that he/she/they is/are an individual aged eighteen or older, medically fit and in good general health, capable of participating in The Point’s activities (hereinafter the “Retreat”).

 

The Participant understands the importance of and agrees to wear a life vest when participating in any of the Retreat’s water activities. The Participant agrees not to operate any motorized water vehicles.

 

The Participant permits the use of any photos, films, or sketches of himself/herself/themselves taken during or related to the Activities for publicity, advertising, promotion or other commercial purpose. The Participant permits use of his/her/their email for correspondence from The Point.

 

The Participant further states that his/her/their participation in the Retreat is voluntary and elective, and that the Participant does hereby for him/her/them self(ves), their heirs, personal representatives, and assigns, release and forever discharge The Point, and its members, officers, employees, agents, and/or assigns of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity, arising from or by reason of any bodily or personal injury or illness, known or unknown, including but not limited to food borne illnesses, death, and/or property damage resulting from any accident which may occur as a result of participation in the Retreat, whether by negligence or otherwise.

 

In the same way and to the same extent, the Participant does hereby release and forever discharge Loon Point, LLC, its members, officers, employees, agents, and/or assigns of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity, arising from or by reason of any bodily or personal injuries or illnesses, known or unknown, including but not limited to food borne illnesses, death, and/or property damage resulting from or on any premises owned by Loon Point, LLC that is used or accessed for purposes of the Retreat.

 

The Participant understands that every reasonable precaution will be taken to ensure his/her/their personal safety and the safety of the Participant’s personal belongings.

 

The Participant has been advised of his/her/their right to consult with an attorney of their choosing in regard to this general liability waiver and hold harmless agreement.

 

The Participant acknowledges that The Point, LLC assumes no duty or responsibility for the management or treatment of his/her/their medical issues or concerns, including the duty to make diagnoses. For diagnosis, management, and treatment, the Participant relies solely on his/her/their medical doctor(s). All medical issues and concerns should be discussed with and must be managed by your doctor. The Point, LLC does not replace any physicians’ or clinicians’ medical advice or recommended treatment.

 

This general liability waiver and hold harmless agreement is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
