General Liability Waiver and Hold Harmless Agreement

The Participant understands the importance of and agrees to wear a life vest when participating in any water activities. The Participant agrees not to operate any motorized water vehicles.

The Participant permits the use of any photos, films, or sketches of the Participant taken during or related to the Retreat for publicity, advertising, promotion or other commercial purpose. The Participant permits use of the Participant’s email for correspondence from The Point.

The Participant understands that every reasonable precaution will be taken to ensure the Participant’s personal safety and the safety of the Participant’s personal belongings, but
the Participant acknowledges that the Participant’s participation in the Retreat is voluntary and elective, and that the Participant does hereby for him/her/themself, and for the Participant’s heirs, personal representatives, and assigns, release and forever discharge The Point, and its members, officers, employees, agents, and/or assigns of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity, arising from or by reason of any bodily or personal injury or illness, known or unknown, including but not limited to food borne illnesses, death, and/or property damage resulting from any accident which may occur as a result of participation in the Retreat, whether by negligence or otherwise.

In the same way and to the same extent, the Participant does hereby release and forever discharge The Point, its members, officers, employees, agents, and/or assigns of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity, arising from or by reason of any bodily or personal injuries or illnesses, known or unknown, including but not limited to food borne illnesses, death, and/or property damage resulting from or on any premises owned by The Point that is used or accessed for purposes of the Retreat.

The Participant has been advised of the Participant’s right to consult with an attorney of their choosing in regard to this general liability waiver and hold harmless agreement.

The Participant acknowledges that The Point assumes no duty or responsibility for the management or treatment of the Participant’s medical issues or concerns, including the duty to make diagnoses. For diagnosis, management, and treatment, the Participant relies solely on the Participant’s medical doctor(s). All medical issues and concerns should be discussed with and must be managed by the Participant’s doctor. The Point and/or the Retreat does not replace any physicians’ or clinicians’ medical advice or recommended treatment.

This general liability waiver and hold harmless agreement is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

COVID-19 NOTICE

Participants are required to practice social distancing and follow current CDC and state guidelines relating to COVID-19 while participating in the Retreat, including but not limited to the wearing of masks. Participant assumes any risk of contracting COVID-19 or similar viral strains, illness, or disease (collectively “Viruses”) while participating in the Retreat. Participant releases The Point from any claims of liability or for damages relating to or resulting from Viruses.
